The beginning of service of process is fairly impossible to date and has been lost in time. However, law enforcement itself began centuries ago. The Code of Hummurabi (a Codification of Babylonian laws, dated 1728-1686 BC). Historically, we know that Athens held jury trials, and that Julius Caesar established the first civil police force. In addition, the Magna Carta, dated in 1297 set forth expressed liberties. The Common Law Procedure Act, dated 1852, documented, with particularity, service of process laws. In 1874, “The Solicitors Journal” published a case report in which the court stated, “The class of persons known as ‘process servers’. . . ” Thus, those serving process were thereby more formally named, process servers.
